In this paper, we present a design tool, the positioning cards that we have developed, validated, and used in different projects. These cards are built to allow CI4CG and Participatory Design researchers to discuss the political alignment of design projects, in iterative processes of design involving people in the definition of the technological features to be implemented. The background of the cards is the conceptualization of contemporary participatory design as public design, engaging with societally relevant phenomena outside the traditional environment (...) of the workplace. To engage with such an extended dimension of participatory design, we frame our contribution in the contemporary form of capitalism, stressing how contemporary capitalism dispossess the wealth created by social production. In this context, we argue, CI4CG designers need to engage deeply with the theoretical implications of their work. To support this effort, we built the cards combining a political perspective oriented toward nourishing the common—the ensemble of the material and symbolic elements tieing together human beings—with the “affect turn” in the social sciences—therefore including affective dimensions like joy, sadness, and desire in the design of CI4CG technologies. Depuis quelque temps, les spécialistes de Machiavel ont dédié leur attention, d’une part, au rôle des tumultes et de l’autre, à la présence de la langue de la jurisprudence dans son œuvre. Jusqu’à présent, ces deux lectures de Machiavel ne sont pas rencontrées. Cette contribution entend montrer jusqu’à quel point la langue de la jurisprudence est présente dans l’écriture de Machiavel sur les tumultes, dans ses premiers textes comme, surtout, dans ses Histoires florentines. En partant de l’analyse machiavélienne de la (...) rébellion de la Valdichiana, la première partie de l’article traite de la rébellion comme problème juridique et politique, comme cas spécifique du crime de lèse-majesté, traité par les juristes de droit civil et de droit canon, depuis les commentaires des lois impériales d’Henri VII jusqu’aux consilia rédigés en défense de Laurent de Médicis et de la cité de Florence à l’occasion de la conjuration des Pazzi, ainsi qu’au premier traité dédié aux séditions écrit par le juriste français Nicolas Bohier. Dans un second temps, on prend en considération le discours du Ciompo anonyme des Histoires florentines et on analyse un passage rarement pris en compte par les commentateurs : « Là où beaucoup se trompent, peu sont châtiés ». Dans ce passage, Machiavel utilise un principe juridique, une regula iuris, certes controversée et souvent non acceptée, mais théoriquement admise comme telle. Abbiamo rivolto una serie di domande ad Angela de Benedictis e a Raffaele Laudani, autori di due volume che mettono in primo piano il rapporto tra obbedienza e disobbedienza. Il confronto riguarda una serie di concetti politici fondamentali all'interno della storia costituzionale moderna: resistenza, ribellione, rivoluzione, potere costituente, sovranità. Fondamentali risultano i linguaggi con i quali trovano espressione le contestazioni dell'ordine, in particolare il linguaggio giuridico che è spesso usato sia per contestare l'ordine sia per confermarlo. Non da ultimo (...) emerge l'importanza che la disobbedienza ha avuto per costituire lo spazio politico europeo e atlantico. (shrink)

In recent years, scholars of Machiavelli have dedicated closer attention to, on one hand, the role played by tumults, and the presence of the language of jurisprudence in his work. Until now, these two readings of Machiavelli have never intersected. This essay aims to show to what extent the language of jurisprudence was present in Machiavelli’s writings on tumults both in his early works, and above all in the Florentine Histories. Starting from Machiavelli’s analysis of the Valdichiana rebellion (1503), the (...) first part of the essay deals with ‘rebellion’ as a legal and political issue, as a specific case of the crime of lese majesty, discussed among civil and canon lawyers from commentaries on the famous imperial laws of Henry VII (1313) up through some legal consilia written in defense of Lorenzo de’ Medici and the city of Florence in relation to the Pazzi Conspiracy (1478), as well as first treatise dedicated specifically to the subject of seditions by a French jurist (1515). The essay’s second part considers the famous speech of the anonymous Ciompo in the third book of the Florentine Histories, and analyses a passage commonly overlooked by scholars : “When many err, no one is punished”. The essay shows that in this passage Machiavelli used a juridical principle, a regula iuris, which was certainly controversial and very frequently not accepted, but theoretically admitted as such. In concluding, the essay proposes some possible paths for further researchs. (shrink)

Antecedente. Se considera «eutanasia» al acto de acabar con la vida del paciente a petición expresa de él, para terminar el sufrimiento propio de alguna enfermedad sin perspectiva de cura. Objetivo. Evaluar los conocimientos y la percepción sobre la eutanasia en estudiantes y profesionales de medicina, demostrando los conocimientos y clasificando la percepción sobre la eutanasia. Metodología. Estudio clínico-epidemiológico, observacional, cualitativo-cuantitativo, de corte transversal y con muestreo no probabilístico por conveniencia, en los estudiantes y profesionales de medicina de un hospital (...) en Venezuela. Resultados. La muestra estudiada tuvo una distribución según grado de instrucción: 64.85% de estudiantes, 19.33% de residentes y 15.82% de especialistas. Presentaron un grado de conocimiento medio, distribuido en 84.4% de especialistas, 77.3% de residentes y 80.5% de estudiantes (p 0.051). De acuerdo con los grados de conocimiento y el apoyo a la eutanasia, el 76.18% tiene un grado medio de conocimientos (p 0.0002). Conclusión. Se demostró que existe un grado medio de conocimiento, en particular en la población estudiantil. La eutanasia no fue percibida de manera negativa, demostrando una alta significancia en la atención a las implicaciones éticas que rodean este concepto. (shrink)

Ethical approval must be obtained before medical research can start. We describe the differences in EA for an pseudonymous, non-interventional, observational European study. Sixteen European national coordinators of the international study on very old intensive care patients answered an online questionnaire concerning their experience getting EA. N = 8/16 of the NCs could apply at one single national ethical committee, while the others had to apply to various regional ECs and/or individual hospital institutional research boards. The time between applying for (...) EA and the first decision varied between 7 days and 300 days. In 9/16 informed consent from the patient was not deemed necessary; in 7/16 informed consent was required from the patient or relatives. The upload of coded data to a central database required additional information in 14/16. In 4/16 the NCs had to ask separate approval to keep a subject identification code list to de-pseudonymize the patients if questions would occur. Only 2/16 of the NCs agreed that informed consent was necessary for this observational study. Overall, 6/16 of the NCs were satisfied with the entire process and 8/16 were unsatisfied. 11/16 would welcome a European central EC that would judge observational studies for all European countries. Variations in the process and prolonged time needed to get EA for observational studies hampers inclusion of patients in some European countries. This might have a negative influence on the external validity. Further harmonization of ethical approval process across Europe is welcomed for low-risk observational studies. Getting ethical approval for low-risk, non-interventional, observational studies varies enormously across European countries. (shrink)

A number of experiences have demonstrated how digital solutions are effective in improving quality of life (QoL) and health outcomes for older adults. Smart Health Age-Friendly Environments (SHAFE) is a new concept introduced in Europe since 2017 that combines the concept of Age-Friendly Environments with Information Technologies, supported by health and community care to improve the health and disease management of older adults and during the life-course. This chapter aims to provide an initial overview of the experiences available not only (...) in Europe, based on the research work of the participants of the International Interdisciplinary Network on Health and Well-being in an Age-Friendly Digital World (NET4Age-Friendly), which could be of interest to preventive, health and social authorities. The chapter reports good practices, pain points, and bottlenecks that may require a collaborative, interdisciplinary research approach to facilitate the transformations towards smart, sustainable, health and age-friendly cities and communities. The volume presents the proceedings of the international symposium, fruit of a common research project engaged in by 48 scholars, that took place in Rome to celebrate the 8th centennial of Saint Bonaventure's birth. The theme, "Deus summe cognoscibilis", could sound, in the contemporary agnostic, secular context, like a provocation. The approach, however, of the symposium was to consider "the current theological relevance of Saint Bonaventure", focusing on thinking with our author about a number of themes: theological method (philosophy, theology (...) and mysticism); revelation (in Scripture and history); creation (in Laudato si' and evolution); Christology (the triplex Verbum and logos of the Cross); ecclesiology and Trinitarian dimensions of sacramental theology; pre-phenomenological Trinitarian theology, and our own divine filiation. An appendix contains a previously unpublished text of J. Ratzinger about Bonaventure's theological method. The volume has also two indexes (authors' names and references to the works of Bonaventure). This book offers new critical perspectives on the relationship between the notions of speculation, logic and reality in Hegel's thought as basis for his philosophical account of nature, history, spirit and human experience. The systematic functions of logic and pure thought are explored in their concrete forms and processual progression from subjective spirit to philosophy of right, society, the notion of habit, the idea of work, art, religion and science. Engaging the relation between the Logic and its realisations, this book (...) shows the internal tension that inhabits Hegel's philosophy at the intersection of logical speculation and concrete analysis. The investigation of this tension allows for a hermeneutical approach that demystifies the common view of Hegel's idealism as a form of abstract thought, while allowing for a new assessment of the importance of speculation for a concrete understanding of the world. In this interview, Maurizio Lazzarato revisits his interest in the work of Gabriel Tarde . He then reflects upon recent uses of the couple biopower/biopolitics, as well as upon the place of the “common” in the theory of the Multitude. He concludes by sketching some of the political implications of the philosophy of difference, which invites us to recognize and unleash the productive powers of variation and experimentation.

Starting from the doctrine of ideology proposed by Destutt de Tracy in the late eighteenth century, the paper reconstructs its historical relationship with the social science, of which it was originally meant to be the ultimate expression. The historical necessity of ideology as a political science of the social is found in its ability to mediate and legitimize power relationships. It is not for chance that the Marxian critique of ideology is a radical critique of the constitution of power in (...) a capitalist society. The attempt of the social science to neutralize the problem of power through the abandonment of the value judgments leads instead to the declaration of the end of ideologies. In the last part, the paper analyses the way in which ideology, after its identification with the forms of total domination, returns as a neoliberal tool of legitimizing market as a society without history. Founded on the mode of « coordination », the struggle of the « intermittents et précaires » of the Greater Paris area is a genuine laboratory which has the means to bring to light the invalidation of the political schema stemming front the socialist and communist tradition. Where the latter insists on a logic of contradiction, of the political representation of an injustice which stages remarkable identities, the political form of « coordination » is resolutely expressive, transformist, and attentive to (...) the unstable dynamics of post-identity identities which weave together the reality of our world. Coordination does not aim at the constitution of a unitary collective which seeks to guarantee the equality of its members at any cost, but rather, at the emergence and « becoming » of singularities which it brings together in an unstable rmtltiplicity, a network, a form always close to the patchwork - exceeding any theoretical definition, but also any appropriation by union forces or State representations. A politics of experimentation which dismisses prior forms of knowledge and opens itself up to the unknown, without which no new form of life is imaginable. (shrink)

Résumé La généalogie du capitalisme amorcée par Foucault à la fin des années 70 ébranle ce que nous croyons savoir du libéralisme. Le constat d’Adam Smith conserve toute sa force : le politique (droits) et l’économie (intérêts) ne sont ni superposables, ni réconciliables. Le gouvernement libéral se propose d’y répondre. Englober et « passer par l’extérieur », telles sont ses tâches, et elles connaissent deux modalités d’application depuis lors, qui sont aussi deux techniques de normalisation. La première, prédominante, s’occupe du (...) gros : la discipline. La seconde, active et souterraine, s’occupe des détails : la sécurité. Elle cerne de plus près les multiplicités, la vie, les conduites. Une véritable politique des multiplicités supposerait, bien davantage encore, de passer « par l’extérieur » des agents que nous tenons pour naturels ou spontanés, mais qui sont l’objet d’un souci et d’une ré-institution constants : le marché, l’entreprise, le travailleur. An analysis on St. Augustine's dialogue on the usefulness of faith (De utilitate credendi), where the distinction between authority and faith is critically discussed.

L'article s'attaque aux racines mêmes du « mystère platonicien » en partant du constat de son caractère proprement « inexplicable »: qu'un auteur, dont on possède l'ensemble de l'œuvre écrite autorise des lectures, non seulement diverses, ce qui est légitime, mais également contradictoires, n'a aucun sens. L'article indique brièvement les éléments qui expliquent cette situation paradoxale et met en valeur les contributions de l'École de Tübingen (Krämer, Gaiser), qui insistent sur les « auto-témoignages » de Platon et sur la tradition (...) indirecte en vue d'une compréhension tout à fait nouvelle de Platon. L'auteur tente ensuite de dissiper quelques-unes des équivoques les plus graves qui grèvent le débat qu'elles ont suscité. L'article expose les analyses de Reale, qui éclairent d'un jour nouveau la valeur paradigmatique de cette nouvelle position, et l'apport de Szlezák, qui produit l'analyse des techniques d'écriture employées par Platon. Les commentaires de Movia et de Migliori prouvent finalement la puissance herméneutique du « nouveau paradigme » et apportent une série d'approfondissements explicatifs, surtout au sujet de la dialectique. The article tackles the roots of the « Plato mystery », beginning with its « inexplicable » existence. It is a nonsensical that an author, whose written corpus we possess, is not only open to different valid interpretations, but even to contradictory ones. After pointing out the elements behind this paradoxical situation, the contributions of the Tübingen school (Krämer, Gaiser) that enhance Plato's own testimony and the indirect tradition in respect of a renewed Platonic comprehension, are underlined. The author then attempts to eliminate some of the major misunderstandings which blocked the previous debate. The article exposes Reale's analysis, who clarifies the paradigmatic value of the new proposal, and the Szlezák's contribution, who threats the analysis of the writing techniques of Plato. Finally Movia's and Migliori's commentaries verify the hermeneutical capabilities of the « new paradigma » and bring a set of thorough examination of the dialectic mainly. (shrink)

The paper takes into consideration the different degrees of power and control that can be exercised by the mediator/arbitrator. This issue is investigated with particular regard to such aspects as the nature of the ADR procedure adopted, the cultural context in which the procedure takes place, and the formulation of specific legal norms. The analysis both of a few arbitration rules and some data from real arbitral proceedings shows great reliance on the arbitrator’s discretion and use of common sense, which (...) is in line with the idea itself of arbitration. Moreover, the high degree of power autonomy enjoyed by the arbitrator during the whole procedure derives from the presupposition that the parties accept the arbitrator’s personal opinion and final judgment and from the fact that the majority of the disputes in international commercial arbitration are of a technical and complicated nature. The analysis also shows that the legal background of most arbitrators tends to surface even when they are involved in alternative dispute resolution proceedings and is clearly visible in the orderly allocation of turns and the strict control over the procedures to be followed. Especially when arbitrators are lawyers or judges, they tend to promote a feeling of belonging to the same professional community, which induces a greater spirit of cooperation and a lowering of the control level. Così il tempio egizio allude al divino con la sua intera struttura, ma non ha propriamente un interno, dedicato al culto dell’immagine del dio.L’egittologia contemporanea ha corretto Hegel su questo punto, perché (...) in generale il tempio egizio aveva un interno che custodiva l’immagine della divinità. Tuttavia la tesi di Hegel rimane paradossalmente valida per un caso particolare dell’esperienza egiziana, che egli non poteva conoscere: nella religione monoteista di Amarna il tempio del dio solare Aton non ha immagini e non ha un centro, perché il divino è presente dappertutto, come la luce del sole, che illumina egualmente ogni parte del tempio..Parole chiave: Egitto; architettura; tempio; simbolo; immagine. Interviewees are: Eduardo Viveiros de Castro (anthropologist, Museu Nacional, Rio de Janeiro), Eric Alliez (philosopher, Paris), Jean Claude Polack (psychoanalyst, Paris), Barbara Glowczewski (anthropologist, Paris), Peter Pál Pelbart (philosopher, São Paolo) Janja Rosangela Araujo (master of Capoeira Angola, and professor, Salvador de Bahia) and Jean Jacques Lebel (artist, Paris). According to the interpretation of Hegel, Egyptian religious buildings, and among them especially the temples, represent the beginning of the history of architecture, and so the beginning of the entire history of art.The Egyptian religious architecture has a symbolic character, because its configuration tries to represent the spiritual content without being fully adequate to it. So the Egyptian temple alludes to the divine through its entire structure, but does not have a proper internal space, dedicated to the worship of the (...) image of God.On this point, contemporary Egyptology corrected Hegel’s view, because broadly speaking the Egyptian temple had an interior where the image of the deity was safeguarded. However, Hegel’s thesis paradoxically remains suitable for a particular case of the Egyptian experience that he could not know at that time: in the monotheistic religion of Amarna, the temple of the sun-god Aton has no images and does not have a center, because the Divine is present everywhere, like the sunlight that illuminates equally all over the temple. Starting from a historical-juridical study of A. M. de Aldama on the origin and evolution of the reference to the teaching of Christian doctrine to pueri contained in the formula of final vows of all priests in the Society of Jesus, the author investigates the meaning of this ministry and its importance today. In an analytic section, the article traces the historical development of the ministry of education in Christian doctrine to pueri and rudes in the experience of Ignatius and (...) his first companions and in the foundational texts. The theme is treated above all in the light of some questions brought up by the historical data of the past and present. In conclusion the author seeks to reply synthetically to the questions, by showing some essential elements in the significance of the ministry of teaching Christian doctrine to children for an apostle in today's world.
